Types Of Bankruptcies
- Chapter 7
Chapter 7 is what most people think of when they are considering filing a personal bankruptcy. This type of case is also known as a “liquation” bankruptcy. These cases typically take about four months. You are allowed to keep certain protected or “exempt” assets. The remainder of your assets are used by the Bankruptcy Trustee to pay your creditors. At the end of the case, most of your non-secured debts are eliminated or “discharged.” There are certain income requirements to qualify for Chapter 7. During your initial consultation, your attorney will review your qualification for Chapter 7, which of your assets can be protected, and which debts can be discharged.
- Chapter 13
Chapter 13 is often referred to as a “reorganization” bankruptcy. Individuals and families who do not qualify for Chapter 7 often file these types of bankruptcy cases. In Chapter 13 cases, the court approves a payment plan based on your ability to pay. You pay on the plan between 3 to 5 years, and your case remains open that entire time. If you complete the payment plan, most of your remaining unsecured debts will be discharged. If Chapter 13 is the best option for you, your attorney will review the details of your payment plan before filing your petition.
